征地困境成因分析

摘 要：
征地难的现象在全国普遍存在,征地困境形成的主要原因在于以行政手段为主的征地补偿标准确定方式、农村集体土地产权制度以及以“大政府”为特征的经济管理体制存在的弊端。在以政府为主导的情况下,无论是传统的产值倍数法还是目前推行的征地区片综合地价法得到的补偿标准都难以做到公平合理。农村集体土地的所有权主体不明确、产权内容不清晰使得征地过程中矛盾频发。政府干预过多,导致违法征地、盲目征地、低价补偿现象层出不穷,使征地困境愈发难以解决。

It is difficult or troublesome to requisite agricultural land for public or non-farming uses. This crux is universal in today' s rural China. That is done usually in administrative ways and compensations are often insufficient or irrational, while behind that stand the local "omnipotent" administrative agencies. The land ownership and property rights of land are made blurred, hence the land value or price can be intentionally depressed
