厦门海洋保护区与渔业生产空间冲突及其对策

摘  要：
建立海洋保护区是保护我国海洋生态资源的有效途径。在对我国海洋保护区中有关海洋自然保护区和海洋特别保护区分类法理进行辨析的基础上,以厦门为例,阐述了厦门珍稀海洋物种国家级自然保护区的设立与当地渔业生产之间存在着严重的空间冲突,并在我国现有法律框架内,提出"先申请撤销海洋自然保护区,再申请设立海洋特别保护区,而后进行非封闭式管理"的对策建议,以期化解海洋保护区与渔业生产发展之间的矛盾和冲突。

摘  要：
Through the jurisprudential analysis of Marine Nature Reserve and Marine Special Protected Areas under the concept of Marine Protected Areas, this paper took Xiamen as the example to elaborate that there is a serious space conflict between the establishment of the National Nature Reserve of Xiamen Rare Marine Species and the local fishery production. Based on the discussion above, this paper proposed within the existing legal framework in China that "firstly repeal Marine Nature Reserve, secondly apply the establishment of Marine Special Protected Areas, and finally implement non-closed management."
