统筹城乡背景下森林资源流转法律问题研究——以重庆市森林资源流转改革为例

摘  要：
通过对森林资源物权概念的拟定,从行政化与物权化博弈的角度重新界定森林资源流转。在此基础上,对重庆森林资源流转立法存在的流转形式内涵外延界定不清、流转方式立法缺失等现状进行了探讨,并提出了完善森林资源流转制度的建议:进一步明确合法的流转方式,确立抵押、继承的流转方式,流转限制制度的完善。

摘  要：
Through the establishment of the concept of forest resources property rights,we can re-define the flow of forest resources from the angle,which contains the game between administration and property.On this basis,this article will discuss the status,such as fuzzy definition about connotation and denotation of transfer forms,which existed at legislation on transfer of forest resources in Chongqing,lack of transfer methods and so on,and will further bring forward the suggestions about improvement on the system of the transfer of forest resources,that is to further clarify the legal transfer means,to establish the flow patterns of mortgage and inheritance,and to improve the flow restrictions system.
