消费者知情权与经营者商业秘密权的冲突与平衡——以食品消费为视角

摘  要:
随着餐饮行业的飞速发展,食品安全问题引发消费者的普遍关注。切实维护消费者在消费过程中信息获取知情权有助于餐饮服务行业的健康发展。与此同时,在维护消费者知情权时亦不能忽视对经营者商业秘密的保护。然而在实践中,二者常常存在冲突,其实质是两种利益间的冲突。从冲突产生的原因及解决原则出发,提出具体措施以兼顾二者的利益,促进消费市场秩序的有序发展。

摘  要:
With the rapid development of foodservice industry,more and more consumers attract attention to food safety problems. In the process of consumption,it is helpful for foodservice industry's healthy development to earnestly protect information of consumers' right to know. At the same time,food operator's right of trade secrets can't be ignored when protecting information. While in practice,however,there are conflicts between them,which in essence are conflicts of two different interests. On the basic of analyzing causes of conflicts and solving principles,this issue puts forward concrete measures to mitigate the contradiction and balance interests between them to enhance orderly development of the consumer market.
