土地征收与农民权利的宪法保障问题研究

摘  要：
我国土地征收之所以会造成很多社会悲剧,主要原因之一就是宪法在规范政府土地征收权力、保障农民权利方面没有完全发挥其应有的作用。在现行的土地征收制度中,由于政府既是土地征收的决策者,也是土地征收纠纷的主要裁判者,政府土地征收权力与被征地的农民权利的失衡,使得一些地方政府在土地征收中对保障农民权利重视不够,引起被征地农民的不满,从而引发了一些不利于和谐与稳定的社会悲剧。为根治土地征收纠纷,实现农民权利和国家利益的双赢,应当考虑通过保障农民对土地征收的参与权、构建土地征收宪法评价机制等措施,让宪法发挥更大的作用。

摘  要：
The reason that the land acquisition had been a trigger for many social conflicts was that the constitution was not able to restrain local government act and guarentee peasant's right.The government was the biggest beneficiary and was the leader and the judge of the disputes caused by land acquisition,neither the farmers nor their collective organizations had sufficient capacity to affect the officials and the local government.As a result,the farmer's rights had been ignored thoroughly and it triggered social tragedy went against harmony and stability.As these problems were constitutional matters,to settle the disputes caused by land acquisition properly,a way to control the government power and to protect the rights of farmers so as to maximize the interests of our country and farmers should be found.
