文章阐述了《解释》出台的背景和意义,对《解释》相关规定中"非法购买"的理解进行了法理上的解读,"知道或者应当知道"的司法认定作了一定分析,针对保障《解释》实施中的问题,提出了加强对驯养繁殖、经营利用野生动物或者其制品的监督管理、加大查处破坏野生动物资源刑事案件的执法力度、破除饮食陋习,树立文明科学的饮食观等建议。

摘  要：
This paper explains the background and significance of the production of Interpretation, interprets illegal acquisition in some relevant provisions from the perspective of Jurisprudence and analyses the judicial determination of knew and should have known. Then, this paper advocates that we should strengthen supervision and management of the domestication, breeding and utilization of the wild animals. Meanwhile, we should also strengthen the law enforcement punishing those criminal cases involving destruction of wildlife resources, get rid of the unhealthy eating habits and set up the concept of scientific diet. These measures will help to put the provisions in Interpretation into practices.
