刑罚视阈中刑事责任年龄降低之否定——兼论未成年人犯罪的治理路径

摘  要：
以刑事责任年龄的争议为切入点,通过文献综述以及对比分析,批驳降低刑事责任年龄以治理低龄未成年人犯罪的观点。径行降低刑事责任年龄,忽视刑罚的局限性,不仅解决不了现有问题,反而使更多的未成年人成为打击对象;降低刑事责任年龄,不仅不符合未成年人的身心特点,亦不利于未成年人的健康成长。从救助矫治的角度出发,应当构建以家庭、学校、教育为主,以少年司法体系为保障的综合治理路径。

摘  要：
Takes the dispute over the age of criminal responsibility as the starting point,through literature review and comparative analysis,criticize the viewpoint of reducing the age of criminal responsibility to control juvenile delinquency.Reducing the age of criminal responsibility and ignoring the limitations of penalties will not solve the existing problems,but also make more minors targeted. Reducing the age of criminal responsibility is not only inconsistent with the physical and mental characteristics of minors,but also not conducive to the healthy growth of minors. From the perspective of rescue and correction,a comprehensive governance focusing on families,schools,and education and guaranteed by the juvenile justice system should be established.
