论中越西沙群岛渔业争端及解决机制

摘  要：
介绍了中越西沙群岛渔业争端的历史、现状及争夺海洋权益的实质,分析了中越西沙群岛渔业争端对渔业的影响,主要有渔业资源日趋紧张、渔民安全难以保证和渔民利益得不到保障等,进而提出了落实西沙群岛行政建制,建设海上力量;与越南等周边国家签订合作协议,保护渔场鱼类资源;通过法理证明主权归属,向国际法院提起仲裁等解决机制,期望能对中越西沙群岛渔业争端的解决发挥一定的参考价值。

摘  要：
The history and present situation of dispute on fishery,and the essence of that many countries struggle for sea rights and interests in Xisha Islands between China and Vietnam were introduced.The impacts on fishery caused by the dispute of fishery in Xisha Islands between China and Vietnam were analyzed as follows:fishery resources are decreasing,the safety and interest of fishermen are difficult to guarantee.Then some solving measures were put forward,including implementing the administrative system of Xisha Islands,building marine forces,signing agreement with Vietnam,protecting fishery resources,proving the attribution of sovereignty by legal principle,initiating arbitration to national courts and so on,so as to play certain reference value in the solution of dispute on fishery in Xisha islands between China and Vietnam.
