农民合作社联合社法律地位与法律关系浅探

摘  要：
随着我国农村经济的蓬勃发展,不同模式的农民专业合作社亦在不断地产生和发展。然而,随着农业生产规模的日益扩大,个体合作社已无法满足生产的需要,各类农民专业合作社从分散走向强强联手,已经成为各界的共识。但是,作为一种新型农业经营模式,农民合作社联合社的法律地位与法律关系迄今仍未得到法律的明确规定,导致其管理运作都出现了不少问题。这种缺乏法律监管及可借鉴的管理模式的情况,给这些尚处于摸索阶段的农民合作社联合社的发展带来巨大的困难及风险。因此,归纳和分析现存问题,宜在以后的立法行为上给予农民合作社联合社独立明晰的法人地位和明确其所有的法律关系。

摘  要：
With the development of Farmer Cooperation and growth, Farmer Cooperation into joint has become an inevitable trend. However, the legal positions and the legal relationships of farmer cooperation associated press haven't still been affirmed by our law up to now. It makes the Associated Press difficult to work and manage. Unable to follow, unsystematic,these spontaneous farmer cooperation associated press are exploring multi-agency nature of the joint, and its organizational model, or both in the establishment, operation, governance, etc. have shown a greater randomness. As the result, the future legislative direction should afford the independent legal positions and the clear legal relationships for the associated press.
