摘要：

文章从保护植物新品种国际公约(以下简称UPOV公约)中"农民权利"的概念界定入手,从UPOV公约直接损害发展中国家农民利益、使农民支付高额成本和损害发展中国家农业发展三个角度研究了UPOV公约对发展中国家农民权利的忽视,并提出以印度为模式的发展中国家保护农民权益的途径。

摘要：

Beginning with the definition of "the rights of peasants" in UPOV convention, it was pointed out that UPOV convention ignored the rights of farmers in developing countries in three aspects, i.e., the interests of farmers in developing countries were directly infringed upon by UPOV convention, farmers had to pay high cost, the development of agriculture in developing countries was injured. Ways for protecting interests of farmers in developing countries was also proposed which setting the India mode as an example.
