摘 要:
The system of common property rights has carried out pilot operation in a number of cities in China, which has solved the problem of housing difficulty in low-and middle-income families to a certain extent.However, in the actual operation process, there are problems such as lack of legal system, different standards for setting the proportion of property rights, difficult to define the standards for access to applicable objects, insufficient financial security of construction funds, and unclear regulatory authority. By referring to the successful experience of foreign countries, this paper puts forward suggestions on the improvement of Chinese housing system with shared property rights mainly from the following aspects: Formulate special legislation of housing with shared property rights as soon as possible to make up the legal gap, clarifying the proportion of property rights and the relationship between rights and obligations. Reasonable definition of low-and middle-income standards and improvement of exit mechanism is needed through periodic review.The sources of construction funds is widened. Establishment of specialized management and operation institutions is conducted to ensure fairness and justice in the operation process.
