回归“嵌入性”——三重视角看农地流转困境

摘  要：
我国土地流转在政策引导与具体实施中取得了巨大成就,盘活了地方土地资源,解放了生产力。但是,由于当前乡村的集体产权制度,导致了土地流转过程中的诸多问题。在对经济学、法学关于土地流转困境的诸多原因进行分析后认为,由于土地流转受到了来自于社会、文化与权力关系的影响,体现在土地流转中农户的经营权、决策权、分配权同样受到地方习惯权利体系的渗透,从这个意义上而言,农村土地流转也是一个社会学问题;只有站在"嵌入性"视角去分析现有土地流转的产权困境,才会更有意义。

摘  要：
The land transfer in China made great achievements in policy guidance and concrete implementation,and made an inventory of local land resources and liberated the productive forces.However,due to the current rural collective property systern resulting in a lot of problems in the process of land transfer.This paper analyzed the reasons of economics and the law of the land transfer dilemma,the results showed that the land transfer was influenced by some social,cultural and power relationsing,reflecting the right of management decision-making,allocation of farmers in the land was in the same place was infiltrated by habit right system In this sense,the rural land transfer was also a sociological problem Need to standed in the "embedded" perspective to analyze the existing land transfer property rights dilemma,will be more meaningful.
