摘要：

孟山都公司在其对美国加州环保局环境健康损害评估办公室的诉讼中败诉,导致其旗舰产品草甘膦被列入加州致癌物质清单.这一事件引起我国相关企业及公众的广泛关注.被告将草甘膦列入致癌物质清单/要求加贴警示标签的做法,虽然经受住了加州弗雷斯诺县高级法院的违宪审查,但涉嫌违反美国政府在WTO《SPS协议》项下所承担的义务,同时还构成我国贸易壁垒调查制度意义上的贸易壁垒.

摘要：

Monsanto Company's failure in its lawsuit against the Office of Environmental Health Hazard Assessment of California (OEHHA) led its flagship product glyphosate to be listed on the Proposition 65 List of Chemicals of California,which has aroused widespread concern in Chinese related enterprises and the public.Although the measures OEHHA had taken to add glyphosate on the carcinogenic substance list were constitutional under the decision of Fresno County Superior Court,they are suspected of violating the obligations of the US government under the WTO SPS agreement,and also constituting a trade barrier in the perspective of China's trade barrier investigation mechanism.
