土地承包经营权若干问题探讨

摘要：

农村土地承包法及其相关司法解释的出台进一步规范了农村土地承包经营权,但是该制度在很多方面依然存在不足。立法应当明确肯定并实际赋予土地承包经营权的物权性质和内容,建立土地承包经营权的统一登记制度,逐步放宽该权利的流转限制,制定土地承包经营权征收征用后土地补偿费用的分配规则,由此来进一步完善我国土地承包经营权制度。

摘要：

Law of farm's land contract and the relevant judicial interpretations provides further rules for the right of farm's land contracting operation,but there is still some disadvantages in many aspects.The law should actually confirm and give the right of farm's land contracting the nature and content of property right,establish a unified system for the registration of the right of farm's land contracting,reduce the limits on transformation of the right,set rules for the delivery of compensations for the levied right of farm's land contracting,so that the system of right farm's land contracting in our country can be improved.
