摘 要：
介绍了乡村旅游用地与农村集体用地的关系,其实质是在乡村旅游发展过程中,基于乡村旅游发展需要对农村集体土地的合理利用。乡村旅游用地的获取一般有征地和土地流转两种途径。目前,我国乡村旅游用地的开发对农民的土地权益造成诸多损害,明晰农村土地产权,创新乡村旅游用地开发模式,建立具有旅游禀赋的土地产权交易机制是优化乡村旅游用地获取途径,切实保障农民土地权益的关键。

摘 要：
The relationship between rural tourism land and rural collective land is introduced,its essence is the optimal use of rural collective land in the developing process of rural tourism based on the development needs of rural tourism.Generally,there are two ways for getting rural tourism land: farmland expropriation and land transfer.At present,the rural tourism development in China caused a lot of damage to the land rights of farmers.Defining rural land property,innovating development model,setting up property with tourism endowments of the trading mechanism are keys of optimizing access to rural tourism land and protecting conscientiously the land rights of farmers.
