新一轮林改:落实和保护平民财产权利的制度创新——集体林权改革研究之一

摘  要：
福建新一轮林改实现了林业财产权利的平民性,这一历史性突破是通过制度创新来实现的。新一轮林改实际上是对具有非平民性的集体林业产权制度进行改革,形成了以平民财产权利为核心的新制度,并建立起多层次、多角度的保护平民财产权利的制度。主要包括:公平权利的基础性保护;法律形式的最高保护;流动保护的产权运行机制;财产变资本的制度安排。

摘  要：
A new round of forest reform in Fujian make the forest property rights civilian.This histrionic breakthrough is implemented by system's innovation.A new round of forest reform is actually a reform of collective forest property right system which is non-civilian,and formed a new system which take populace property right as the core,and establish a multi-level,multi-angle of civilian property rights protection system,including fair basis for protection for,the highest forms to protect,flow mechanism to protect property rights,institutional arrangements property for capital.
