赫哲族传统渔业习惯法的经济学分析

摘  要：
赫哲族人民在长期的渔业生产过程中,形成了独特的渔业习惯法,其内容涵盖了捕鱼前的祭祀、捕鱼组织、渔场占有、渔产品分配等各方面。这些习惯法和禁忌共同构成了赫哲族传统渔业生产的规则体系。从中我们可发现较强的经济逻辑:制度规范经济,同时随着经济的发展制度必须相应的调整以适合经济的需要;应对高昂的信息成本,只能采取对隐私权的否定,但这在某种程度上又会阻碍技术的进步;在一个自给自足的熟人社会里,"产权"难以长期得到尊重和维护;而在一个非熟人社会里,为了维护生产秩序和经济效应,产权反而更容易获得尊重和维护;长期博弈中,需要遵守规则维护信誉,在应对无法独自承担的风险,分散风险是最好的办法。

摘  要：
Hezhe people have formed unique fisheries customary law in the long-term fisheries production process which covers pre-fishing ritual,fishing organizations,fisheries possession,and fishery products distribution.These customary laws and taboos together constitute a system of rules of the Hezhe traditional fishery production.From it we can find a strong economic logic:system specifies economic,at the same time the system must be adjusted accordingly to suit the needs of the economy as the economic development;It is a good way to take the denial of privacy when response to the high information costs,in a kinds extent will impede the progress of technology;the acquaintance of a self-sufficient society,"property" is difficult to get long-term respect and maintenance;in a non-αcquaintance society,in order to maintain order and economic effect,property rights are even more easy to obtain respected and upheld;game,need to abide by the rules to maintain credibility in response to the risks that can't solely responsible for risk diversification is the best way.
