摘 要：
后疫情时代,网络消费所占的比重增加,关于网络代购的法律纠纷也频频成为焦点.由于《电子商务法》至今缺乏配套的实施细则,目前实践中存在的一些法律适用争议问题仍将持续存在,因而结合《民法典》对相关问题进行总结和研究显得尤为重要.本文将网络代购行为中买卖关系与委托关系如何确定这一争议问题作为研究对象,结合已有的实践和理论研究,探讨影响买卖关系与委托关系确定的因素,以期对未来司法实践提供参考.
