集体建设用地流转影响效应及障碍因素分析

摘  要:
本文探讨影响集体建设用地流转涉及的深层次问题,疏通集体建设用地流转的通道。分析了集体建设用地流转对土地一级市场的国家垄断、对土地市场供应和收入模式产生的冲击和重要影响;讨论现行制度对集体建设用地流转的限制规定、对集体建设用地流转用途限制以及集体建设用地权利的界定等对集体建设用地流转形成的制约作用。认为应该对未来城乡土地市场进行重新认识和构建,修改和完善现有的制度和政策规定,使集体建设用地流转真正纳入到城乡统一的土地市场之中。

摘  要:
The object of paper is to probe the key issues related to transaction of collective construction land,in order to build the legal approach of transaction.It has analyzed the influence of collective construction land transaction on urban land market monopolized by the state,and the impact on land supply pattern and income mode.It discussed major obstacles for formation of collective construction land transaction,including restriction and stipulation on collective construction land transaction by current institution,restriction on land use purpose after transaction,and definition on the right of collective construction land.It suggested that it is necessary to rethink the land market from the view of urban-rural development,and revise the current legal system,so as to bring the collective construction land into land market legally and efficiently.
