云南古茶树资源保护的地方立法与制度的完善

摘  要：
开展对古茶树资源保护的法律制度研究,为下一步云南省进行古茶树保护省级立法提供有益思路,具有重要的现实意义。在概述云南省古茶树资源分布状况、基本概念以及面临威胁的基础上,分析了古茶树保护地方立法状况,从多维度探讨古茶树资源保护的必要性。针对古茶树资源法律保护中存在的问题,从可持续发展,宽严相济、分级分类因地制宜,生态效益补偿,公众参与和技术标准六个方面提出建议,以期对云南省古茶树资源法律保护制度的完善提供参考。

摘  要：
The study of the legal protection system of ancient tea tree resources provides helpful reflection for the provincial legislation of ancient tea tree protection in Yunnan Province, which has important practical significance. Based on the introduction of the distribution, basic concepts and threats of ancient tea tree resources in Yunnan Province, this paper analyzes the local legislation of ancient tea tree protection, and explores the necessity of ancient tea tree resource protection from multiple dimensions. In view of the problems existing in the legal protection of ancient tea tree resources, this paper puts forward some suggestions from 6 aspects: sustainable development, combination of leniency and strictness, classification and adaptation to local conditions, compensation for ecological benefits, public participation and technical standards, with a view to improving the legal protection system of ancient tea tree resources.
