农地流转中村集体的角色定位与“三权”权能完善

摘  要：
本文运用理论分析和文献研究法,基于强化农地流转过程中集体土地所有权的主体地位,完善农地流转权能设计,优化农地流转运行机制。研究表明,应明确村集体在农地流转中的法律地位和重要作用;集体土地所有权享有农地流转的管理与服务权能,农户土地承包权拥有农地流转的决策与收益权能,土地经营权体现为劳动生产和经营收益权能;促进农地流转由农户自发流转向村集体委托—代理流转方式的转化。现阶段应强化集体土地所有权的农地流转管理与服务权能,在农地流转过程中村集体既不能缺位,也不能越位、错位。

摘  要：
The purpose of this paper is to optimize the operation mechanism of agricultural land transfer,to improve the rights design of agricultural land transfer,based on enhancing collective ownership of land's subjective status of agricultural land transfer.Theoretical analysis and literature research method are used in this study,and the results are showed as follows: the legal status and important role of village collective in agricultural land transfer are clarified.Collective owners of lands is entitled to the rights of management and servicing to the agricultural land transfer;contractor of farmers' lands has the right of decision making on and equity profit from the agricultural land transfer;the right of land management is illustrated as the right of farming,producing and cash flow profit from the agricultural land transfer.To promote the agricultural from the spontaneous pattern led by farmers to the collective principal-agent pattern.Therefore,at the present stage,we should strengthen the rights of management and servicing in agricultural land transfer.In the process of agricultural land transfer,the village collective can neither be absent,nor offside,dislocated.
