南方集体林权改革纠纷预防机制研究——基于度量和界定费用的视角

摘  要：
自集体林权制度改革全面推进至今,我国各地集体林权纠纷频繁爆发,且呈现出较为明显的增长趋势,不仅严重影响了各地集体林权改革的效果,而且影响了经济发展和社会稳定,如果解决不好,甚至导致群体性事件的发生。文章在南方6省实地调研的基础上,从产权的度量和界定的费用角度,通过系统梳理集体林权改革纠纷的成因,探讨了纠纷解决所面临的困境,最后就纠纷防范给出了对策建议,以期为集体林权改革提供一定的理论依据。

摘  要：
Since the reform of the collective forest tenure system had been carried out so far, the collective forest tenure disputes had frequently erupted and showed a more obvious growth trend. It not only seriously restricted the effectiveness of collective forest tenure reform, but also affected its economic development and social stability. If it couldn't be solved properly, it might lead to mass events. Based on the field research of six provinces in South China,from the perspective of costs of measurement and definition, this article systematically combed the causes of the collective forest tenure reform disputes, and explored the plight of the dispute resolution. Finally, the countermeasures and suggestions were given from the two aspects of dispute prevention and resolution, so as to provide some theoretical basis for collective forest tenure reform.
