对建立责任保险代位赔偿制度的探讨

摘  要：
为探讨建立责任保险代位赔偿制度,论文从渔业互助保险协会理赔实务出収,定义代位赔偿的概念,分析其特征,指出它与"代位追偿"、"债务承担"的不同,探讨其存在的法理基础。针对代位赔偿缺少法律法觃的觃定、操作不觃范的现状,为满足保险人的保赔要求,实现快速理赔,应当通过立法,制定相关觃章制度,完善理赔程序,落实责任免除等方面构建代位赔偿制度。

摘  要：
To study to establish liability insurance subrogation make compensation s ystem, this article embarks from the fishery mutual insurance association settlement of claims practice, define the concept of subrogation make compensation, analyzes its characteristics, points out that it has to do with "subrogation recovery" 、 "debt undertake" the difference,discuss the legal basis of existence. For subrogation to make compensate for the lack of laws and regulations, the present situation of the operation is not standard, to meet the requirements of the insurer's protection and indemnit y, achieve rapid settlement of claim, should be through legislation 、formulate relevant rules and regulations 、perfecting settlement of claim procedures、implement the responsibility prevent such aspects as construction of subrogation make compensation system.
