发表权若干问题探微

摘要：

发表权本质上是作者控制自己作品公开的权利,表现为作者对作品发表这一行为和状态的控制力,它具有独立存在的价值。发表权并不是著作财产权或者兼有人身权与财产权的双重属性,它只能是著作人身权。发表权的特点是发表权所具有而其他著作人身权没有的属性。"一次用尽"、"不能转移"、"区别其它著作人身权的显著性"难以成为发表权的特点。发表权的基本特点应着眼于发表权的内容、保护期限、行使主体和方式的特殊性。在作品发表之前作者对一篇作品的发表权可以多次和多种方式行使,在会议上宣读论文也是发表权的行使方式。

摘要：

The right of publication,as a right that is essentially decided by copyright owners,refers to the copyright under which the owners can control over the behavior and status of the publication of work,which has independent value.The right of publication belongs only to the moral rights rather than the property rights or with dual attributes of the moral rights and the property rights.The character of the right of publication is unique compared to other moral rights.Some characters such as "the doctrine of first sale"、"non-transferable"、"distinct from other moral right" shall not constitute the right of publication.The basic character of the right of publication shall be based on the particularity of the content、terms of protecting、exercise of right of copyright owner and manner.Copyright owner shall be entitled to exercise the right of publication on many occasions and a variety of ways,including presenting papers during the conference session.
