政府法治论语境下的社会治理创新

摘  要：
在法治国家、法治政府、法治社会一体化建设进程中,社会治理创新的内在逻辑是推进国家治理体系和治理能力现代化。以现代行政过程为分析基础、以有限行政和有效行政为分析原点的政府法治论,是建构社会治理体系的基础。"依法律善治"既是政府法治论的核心内容,也是政府推进社会治理创新的应然选择。推进政府行政体制改革、促进政府职能转变、健全政府责任体系、构建非政府组织参与机制等是政府"依法律善治"的有效路径。

摘  要：
In the process of the establishment and integration of a rule of law state,a rule of law government,and a rule of law society,the inner logic of social governance innovation is to advance the modernization of state governance system and capability.The government constitutionality theory based on modern administration process and limited and effective administration is the theoretic foundation of social governance system construction.In the analytical framework of the government constitutionality theory,"good governance based on the rule of law"is the core and the inevitable choice of the government in the process of social governance innovation.So,to advance the reform of government administrative system,to change the way the government functions,to improve government responsibility and accountability system,and to construct NGO participation mechanisms and so forth,are the effective means of good governance based on the rule of law.
