基于不确定利率及土地发展权的农用土地征地补偿方案

摘  要:
本文以农用土地年收益现金流为基础,加入利率的不确定性和土地发展权的影响,构造以实际补偿和期望补偿为变量的效用函数作为确定征地的货币补偿金额的工具。得出当前利率下农用土地年收益的折现估计值为年平均收益22倍的结论,而维持农民生活水平不变的补偿费用应在年平均收益30倍以上。现行法律规定的最高30 倍的补偿标准偏低,建议参照项目预算的净现值方法计算,适当提高补偿标准。

摘  要:
The paper develops an improved calculating device by constructing the utility function which uses the real compensation and expected - compensation as variation. Based on the annual discount cash flow of farmland revenue, taking the influence of uncertain interest rate and the land development right into consideration, this function suggests that the annual discount of farmland revenue should be 22 times of the annual average revenue. In the consequence, the paper draws out the conclusion that the compensation should be at least 30 times of the annual average revenue to maintain the farmers' living condition. Since current law' s regulation of at most 30 times is too low, the paper proposed to enhance the compensatory standard according to calculating method given out.
