论刑事附带民事公益诉讼——以生产销售伪劣产品罪为视角

摘  要：
"三聚氰胺事件"的爆发让国家和社会的目光重新聚集到"打击假冒伪劣产品"这一问题上来。但由于目前普通诉讼无法维护群体利益,公益诉讼尚不成熟,现实的处理结果往往令人不满。从案例分析的角度,梳理相关大规模侵害公共利益的案例,并结合公益性刑事附带民事诉讼的相关理论和判例,构建刑事附带民事公益诉讼制度,旨在对生产假冒伪劣产品行为的受害者提供更合适的救济途径,切实维护弱势群体的合法权益。

摘  要：
The outbreak of the "melamine"event make the state and society eyes back to the question of "cracking down on fake and inferior products". But since the ordinary procedure is unable to safeguard the interests of the community,public interest litigation is not mature yet,realistic processing results are often unsatisfactory. Combed the related large-scale infringement cases of public interests,and combine the public welfare of civil suit collateral to criminal proceedings related theories and cases,and lead to criminal incidental civil public interest litigation,this system is designed to provide more suitable to produce fake and inferior products behavior relief way,earnestly safeguard the legitimate rights and interests of vulnerable groups.
