农地使用权保障制度中的西方现代产权理论——以中国新型城镇化建设为背景

摘  要：
中国农村土地制度存在很多不规范的问题,西方现代产权理论的引入有一定的指导和借鉴意义,使得土地制度内部权利体系更加精细化以适应现代市场经济发展的需要。但是,农地自身具有独特的属性:土地的边际递减规律对农地使用权制度设计的影响,中国当代农村土地状况对农地使用权制度设计的影响,农地制度变迁中的路径依赖。这些决定了西方现代产权理论模型无法全部适用。因此,中国城镇化发展的历史背景下农地私有化行不通,土地私有化不利于中国社会转型时期的社会经济稳定发展,农地的利用规律决定了不适用农地的私有化。

摘  要：
China exist many nonstandard problems of rural land system,and the introduction of western modern property right theory has certain guidance and reference,which allow a more sophisticated system of land system internal rights to adapt to the needs of the development of the modern market economy.But the land itself has unique properties:marginal land law of diminishing the impact on the farmland use system design;China's contemporary rural land status of farmland use system design;Farmland path dependence of institutional change.All these determines the western modern property rights theory model could not apply.Therefore,China's urbanization under the background of the history of the development of farmland privatization did not work.Land privatization is not conducive to China's social transformation period and stable development of social economy;The use of farmland law determines the privatization of farmland shall not apply.
