论我国夫妻共同财产制的新发展——以婚姻法解释(三)第七条为例

摘  要：
1950年我国第一部《婚姻法》确立了法定夫妻共同财产制,并一直延续至今。2011年7月4日《解释(三)》"第七条"自制定以来,在房价高涨的社会背景下,触及到了婚姻中房产归属问题,引发了巨大的争议,反映了价值取向上从身份到契约的发展,造成争议背后的本质是我国的夫妻共同财产制走上了精细化区分的道路,"第七条"明显带有分别财产制的倾向,对夫妻共同财产制的新发展具有合理性。

摘  要：
Obiective:In 1950,the first law of marriage in China established the legal joint property system for couples and has continued to this day.July 7th,2011,the seventh article of"the Judicial Interpretation of the Marital Law(III)"has drawn great controversy and reflected the value orientation in the social context of high prices.From the development of identity to contract,the essence behind the controversy is that our country's joint property system has embarked on a fine distinction,and"Article 7"has a tendency to separate the property system and the new development of the husband's common property system.With reasonableness,in practice,the house should be recognized as the joint property of the husband and wife when the parents partially contribute.
