家庭承包之土地承包经营权抵押中的法律问题

摘  要:
虽然国家政策已经打开家庭承包方式取得的土地承包经营权抵押之门,但只对其进行了原则规定,在实践过程中需要法律的详细规定。当务之急是修改农村土地承包法、物权法、担保法等有关内容,明确家庭承包土地经营权抵押的抵押人、抵押权的成立是否必须登记,抵押权的效力是否及于土地的附着物及出产物,尚未与土地分离的农作物、林木是否仍可独立于土地承包经营权与土地承包经营权分别抵押于不同的抵押权人,抵押权的实现方式,承包土地被征收时土地补偿款是否可作为代位物等内容。

摘  要:
Although the national policy has allowed the mortgage of land contract management right obtained from household contract,it is only required on its principles,in practice,the law is required to show detailed provisions. The first priority is to modify the related content in the law of rural land contract 、property law and guarantee law. It should be clear whether the mortgagor and mortgage must be registered which are based on the mortgage of land contract management right obtained from household contract,whether the attachment effect of mortgage should cover things immovably attached to the land and products of the land,whether the products and woods un-separated from the land can separate from the right to land contractual management and can be mortgaged to different mortgagors with the right to land contractual? management,what the realization way of right to mortgage is,and whether the land compensation can be used as subrogation when the contracted land is levied.
