依法治校视域下当代高校权力和学生权利的冲突与平衡问题探究

摘  要：
从依法治校视角考察,当前高校学生管理领域出现的诸如授予学位争议、学籍纠纷、集体维权等问题,其根本上可归结为高校权力运行和学生权利行使过程中所发生的矛盾冲突。在新的历史条件下,要实现高校学生管理法治化,其关键就在于高校权力和学生权利的平衡,不仅需要明确并保障大学生依法享有的权利,也需要明确高校对学生的管理是在正当行使国家教育权力,这就要求我们必须正确认识高校权力和学生权利关系以及二者发生冲突的原因所在,只有弄清楚这些关键问题,才能提出平衡二者冲突的有效路径。

摘  要：
Investigating from the perspective of running a university according to law,there are many problems in the current field of student management,such as disputes over conferring academic degrees,disputes over student status,and collective rights protection,which can be attributed to the conflicts between the operation of university power and the exercise of students′ rights.Under the new historical conditions,the key to realizing the legalization of university students′ management lies in the balance of university power and students′ rights.It is not only necessary to make clear and guarantee the rights enjoyed by university students according to law,but also necessary to make clear that the management of university students is in the proper exercise of state educational power,which requires us correctly understand the relationship between university power and student rights and the reasons for the conflict between them.Only by clarifying these key issues can we propose an effective path to balance the conflicts between them.
