土地信托工具的本质与本土化前景

摘  要：
研究目的:从土地信托发生与发展的角度,结合实地调查研究,探讨中国土地信托的基本特征和发展前景。研究方法:历史文献法、案例分析法。研究结果:方兴未艾的中国土地信托热理论研究基础是不扎实的,对若干重大理论和方法问题的回答还不够清晰;案例研究表明,土地信托的商业利润难以保障,金融工具并未落实,失败风险极大;委托人与受托人之间被村组、乡镇、县行政机构隔开,与国际成功信托模式区别很大,信托关系杂乱不清。研究结论:中国土地信托的发展前景是光明的,但当前重商事、重金融工具、轻信息对称和透明度的土地信托热应该降温,回归到有法律支持的小范围试点水平比较合适。在试点安排上,要注意区分试点选择的区域性、阶段性差异,突出探索以民事信托为基础的商事信托安排。

摘  要：
Purpose:in the perspective of the emergence and development of land trust,combining the field survey,this paper discussed the basic characteristics and developing prospect of the land trust in China.Methodology:historical literature review,case study.Results:the theoretical basis of the ascendant land trust in China is not solid,the answers to a few important theoretical and methodological questions are still not clear;the case study showed that the commercial profits from the land trust could not be guaranteed,the financial instruments are not implemented,which would cause the high risk of failure;the interactions between the clients and the trustees are separated by the administrative organizations,including villages,towns and counties.The differences from the successful trust modes overseas are obvious and the trust relationship is in chaos.Conclusions:the development of the land trust in China has a bright future,however,the current upsurge that focuses on the commercial and financial instrument,while neglects the symmetry of information and information transparency should be cooled down and returned to the pilot projects in small areas with legal support.Regarding to the selection of the pilot projects,we need to distinguish the differences on locations and stages,and to highlight the exploration on the arrangement of commercial trust based on civic trust.
