林权抵押贷款发展现状及法律制度的完善——关于浙江省丽水市农村金融改革试点的思考

摘  要：
针对林权抵押贷款的现状进行剖析,指出林权抵押贷款陷入困境的原因在于政府政策在前行,立法修法未跟进;司法介入不积极,抵押物权处置难;金融机构较势利,小户利益难惠及;评估机构有缺位,评估结论欠客观;利率评估成本高,农户难得真实惠;生态保护日趋大,抵押权人风险增;农户诚信有缺憾,履约观念待加强。建议:加快立法修法速度,确保审判有法可依;机构设置须加规范,市场运作客观公正;扩大社会担保主体,继续推进林权抵押;金融机构多让利,支持"三农"实现双赢;鼓励吸引民间资本,破金融垄断格局等。

摘  要：
The forest right mortgage as derivatives of forest right system reform, the implementation of broaden the scope of the rural areas, farmers financing pawn, revitalize the rich forest resources, and to some extent, the current situation of rural financing difficulties but from launch to after eight years of practice, increasingly decline in business,"the forest right mortgage"directly"forest resources collection and storage center secured loan"two model has been commercial financial institutions, is still in operation mode of "small revolving loan of forest", not with the general credit guarantee loans, is not a real"forest right mortgage", only need to become a mere formality and statistics, the cause of the problem is the defect of the legal system of extended collateral- forests, trees and forest land transfer and treatment of difficult problems. Lishui become central rural financial reform pilot area analyzes the present situation of forest right mortgage, reform and perfect the opinions, and be discussed, for reference.
